Terms and conditions
These are the terms shown in the TrukZone Fleet app before you sign in, and under Settings › About. Read how we handle your data in the privacy policy.
These Terms are an agreement between you and Mirusoft Consultancy (OPC) Private limited ("we", "us", "our"), the developer and operator of TrukZone Fleet — the app on phones and tablets, the version for computers, and the servers and web pages that work with them (together, the "App"). Please read them before you use the App. By tapping "I agree", or by using the App, you accept these Terms. If you do not accept them, please do not use the App.
1. What the App is, and what it is not
The App is a business tool for lorry owners and fleet operators. It helps you keep the records of your fleet — your lorries and their papers, your drivers, your trips, freight, expenses, advances and settlements, your parties, credit parties and diesel bunks, your office book, cash book and bank accounts — and work them with your drivers, who use the TrukZone Driver app. It also lets you see where your lorries are, look for loads, find drivers looking for work, buy and sell lorries, and talk to drivers.
We are not a transport company, broker, freight forwarder, employer, bank, payment service, accountant, tax adviser or GPS company. We do not carry goods, hold or move money, employ your drivers or staff, or guarantee any load, payment, driver, buyer or seller. The money recorded in the App is a record, not a payment: an advance, a collection or a balance entered in the App moves no money anywhere.
2. Who may use the App
You may use the App only if you are at least 18 years old and able to enter into a binding contract. The App is for your transport business. If you use it for a company, a firm or somebody else's fleet, you confirm that you are authorised to accept these Terms for them, and "you" includes that business.
You remain responsible for every permit, registration, fitness certificate, insurance, tax and licence your lorries and drivers need. The App does not check that any of them is genuine, valid or current — not yours, and not anybody else's.
3. Your account, your devices and your office staff
Your fleet account belongs to the mobile number you sign up with, confirmed by a code sent by SMS; you may also set a password. One phone at a time can be signed in with your number — signing in on another phone signs the first one out. You can link computers to your account from your phone, and you can see and sign out the computers that are linked.
With Premium you can add office staff users. You create each person's user name and password and decide what each of them may see and change. A staff user who is given Settings can act very nearly as you can.
Everything done with your number, your password, your linked computers or your staff logins is treated as done by you. Keep your phone, codes and passwords to yourself, give staff only the access they need, and switch a user off as soon as they leave. Tell us promptly if you think somebody is using your account without your permission.
4. Your drivers
Each driver has their own TrukZone Driver account. You can invite a driver to your fleet and a driver can ask to join it, but nobody is added until the other side accepts, and a driver can belong to one fleet at a time. Once a driver has joined, you and the staff you allow can see their name and number, the trips they drive and the money on them, their position as their own settings allow, and the papers they choose to share with you.
You may use what you see about a driver only to run your fleet's work, and only as the law allows. In particular, you will not use a driver's position to follow them outside their work, will tell your drivers how you use the App, and will not pass their information to anybody who has no business need for it. A paper a driver shares with you stays with you after they leave; a paper you file about a driver must be one you are entitled to hold.
Removing a driver takes them off their lorry and out of your fleet's chat group; their trips and papers stay in your records.
Your arrangement with each driver is between you and them. Wages, salary, padi or bata, advances, deductions and settlements are worked out in the App from the rules and figures you and your drivers enter; checking them, paying them and meeting every labour and wage law that applies to you is your responsibility, and any dispute about them is yours to resolve with the driver.
5. The records you keep, and the people in them
Much of what you record is about other people — drivers, office staff, parties, credit parties, diesel bunks, buyers and sellers: their names, phone numbers, towns and balances. You confirm that you are entitled to record it, that you will keep it accurate, and that you will use it only for your business. For that information you decide why it is kept and what it is used for; we store and process it for you, to run the App, and for nothing else. If one of those people asks you to see, correct or remove what you hold about them, that is for you to answer; we will help where the App allows it.
Entries are not deleted from your books: a wrong entry is struck out, leaves the totals, and stays in the cancelled-entries report with who struck it and when. This is deliberate, so that your books can be checked.
6. Figures, reports and printouts
Balances, settlements, profit and loss, cash flow, dashboards, the trip calculator, toll and distance estimates and every other figure in the App are calculated from what you, your staff and your drivers enter, and from rates, maps and toll data that may be out of date or wrong. They are an aid to running your business. They are not accounting, tax, GST or legal advice, and they do not replace the books, returns, invoices, e-way bills or lorry receipts the law requires you to keep. Check anything before you rely on it.
Lorry receipt numbers come from the series you set; what you issue under them, on screen or printed, is your document. Keep your own copies of any record the law requires you to retain — the App is not a statutory archive, and a closed account is erased (clause 22).
7. Loads and load booking offices
Loads shown in the App are posted by load booking offices, including our own load office, and are their offers on their terms. A trip you take is a contract between you, the office and the load party. When you put a lorry on an office's list of lorries waiting for a load, that office sees the lorry, where it is and where you prefer to go. We do not guarantee any load, rate, payment or party, and any dispute about freight, advance, balance, detention, loading, unloading, damage, shortage, delay or cancellation must be taken up with the office or the party concerned.
8. Where your lorries are
The App shows a lorry's position from two sources: your drivers' phones, as and when each driver's own settings allow — live location during a trip is a Premium feature and a driver can switch it off — and your GPS company, if you connect one.
To connect a GPS company you give us the login, API link or token you use with them. You confirm that you are entitled to give it. We keep it on our server and use it only to read your lorries' positions, distance and speed for you; it is never shown back to any app or browser, and it is removed when you delete that GPS company from the App or close your account. The GPS company is yours, not ours, and its terms apply to it.
Positions can be late, approximate or missing. Do not rely on the App for safety, theft recovery or anything else where a wrong or late position could cause harm.
9. Free and Premium plans
The Free plan is the handset app with limits — for example on trips added, trip-calculator runs and the number of trip lorries — shown in Settings › Subscription. Premium adds the tablet and computer layouts, office staff users, live location during trips and the other features listed there. Premium is priced by the number of trip lorries, per year, plus GST. Lorries beyond what your plan covers are kept as office vehicles, with all their records, until your plan has room for them.
When Premium ends, Premium features stop: your records stay, office staff can no longer sign in, the tablet and computer layouts return to the handset screens, and the Free plan's limits apply again.
10. Payments, renewal, trials and refunds
Only the account owner can buy Premium. You can buy it in the App through Google Play or the App Store, or on our website, where payment is handled by Razorpay; we never see your card, bank or UPI details.
- Bought through Google Play or the App Store. Payment is charged to your store account when you confirm the purchase. The subscription renews automatically for another year unless you cancel it at least 24 hours before the end of the current year, and the renewal is charged within the 24 hours before that. You manage and cancel it in your Google Play or App Store account settings; uninstalling the App or closing your fleet account does not cancel it. Where a free trial is offered, you are charged when it ends unless you cancel before then.
- Bought on our website. You pay for the period shown at checkout, and the invoice goes to the email address you give.
- Invoices. Your receipts and GST invoices are in Settings › Subscription. GST details you give us must be correct; we invoice on what you tell us.
- Refunds. Refunds of store purchases are decided by Google or Apple under their own policies — ask them. Apart from that, and from any refund the law requires, payments are not refundable, including for the unused part of a year.
- Price changes. We may change prices. A change applies from your next renewal, and you will be told before it does; Google and Apple may also ask for your agreement.
11. Drivers for hire
The hire board shows drivers who are looking for work, in their own words. We do not check any driver's identity, licence, experience, background or references — do your own checks before you hand anybody a lorry. Asking a driver for an interview sends them your company name and phone number. Employing a driver is between you and that driver. Use what you see on the board only to hire for your own fleet; do not copy, collect or pass it on.
12. The Market — buying and selling lorries
When you put a lorry up for sale, you confirm that you own it or may sell it, and that the details and photographs are true — including any loan, hypothecation or dispute on it. We look at every listing before it goes on the board and may refuse or remove one. Your name and phone number are shown to anybody who opens your listing, in the App or on trukzone.in; the board shows the town, and the exact place is shown only in the App. Mark it sold or take it down when it is no longer for sale.
A sale is between the buyer and the seller. We are not a party to it and do not check the lorry, its papers or either person. Check the RC, the finance clearance, the insurance and the person before any money changes hands, and never pay an advance to somebody you have not met.
13. Chat, groups and the community
There is no tolerance for objectionable content or abusive behaviour on this App. Content that is obscene, threatening, hateful, defamatory, fraudulent or otherwise objectionable is not permitted, and neither are the people who post it. Reports are reviewed within 24 hours; objectionable content is removed, and the account that posted it is barred from chat and the community or closed, without refund and without notice.
You can report a post or a message with the ⚑ Report button beside it, and block a user from the same place, from a chat or from your contacts. Blocking hides that user's posts and messages from you at once and stops them reaching you. Blocked users can be seen and unblocked in Settings.
Messages, photographs, voice notes and locations you send go to the people or the group you send them to, and cannot be taken back from their phones. Chats are kept on your phone, not on our server: our server holds a message only until it is delivered, and for at most seven days if it cannot be. Use Move chats before you change phone; what is lost with a phone cannot be restored by us. Asking for help in the community shows your number to the group, and the App tells you before it does.
What other users tell you — about a road, an office, a mechanic, a party or a load — is their word, not ours. We do not check it.
14. How you must behave
You agree that you will not use the App to:
- break the law, or help anybody else to;
- threaten, abuse, harass, defame or intimidate anybody, or post obscene material;
- cheat or defraud anybody — including with a false load, a false listing, a false interview or a false payment entry — or ask anybody for an OTP, PIN, CVV or banking password;
- pretend to be somebody else, or to be an office, an owner or an official you are not;
- follow, watch or record a person's location for any purpose other than running your fleet's work;
- publish somebody else's personal information, photographs or documents without their consent;
- post advertising, bulk messages, chain messages or spam;
- collect, copy or resell information from the App — the hire board, the Market, other users' details — or use it for anything other than your own transport business;
- share a login or a staff user with another business, or work around a plan's limits;
- interfere with the App or our servers, or try to reach anything you have not been given.
15. What you put in remains yours
Your records, papers, photographs and posts remain yours. You give us permission to store, copy, process and show them, to you and to the people you share them with, as far as is needed to run the App for you. You confirm that you are entitled to put them in. We may keep a reported message as evidence of a complaint. If you send us a suggestion, we may use it without owing you anything.
16. Privacy
What the App collects, why, who sees it and how long it is kept is set out in the TrukZone Fleet Privacy Policy at trukzone.in/fleet/privacy, which forms part of these Terms. In short: we do not sell your data or use it for advertising, and we use the records you keep only to run the App for you.
17. Notifications, availability and working offline
Notifications reach you through Google and Apple and may be late or never arrive; do not rely on them for anything time-critical. Some records, trips among them, can be entered without a connection; they are saved on the device and sent when it reconnects, and until then nobody else sees them. The App needs a working network for most things, and may be unavailable, interrupted or changed at any time. We may add, alter or withdraw features.
18. Services we rely on
The App relies on services we do not control — your mobile network, Google and Apple for app distribution, purchases and notifications, Razorpay for website payments, our SMS provider, map and toll data providers, your GPS company, and our hosting providers. Their terms apply to their parts, and we are not responsible for their acts or failures.
19. No warranty
The App is provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the App will be uninterrupted, timely, secure or error-free, that any figure or information in it is correct or complete, or that any driver, office, party, buyer or seller you deal with through it is honest, solvent, licensed or safe.
20. Limitation of liability
To the fullest extent the law allows, Mirusoft Consultancy (OPC) Private limited, its directors, employees and developers will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, freight, business, goods, vehicle, data or goodwill, however caused, arising out of or in connection with the App or these Terms — including loss arising from a driver, staff user, office, party, buyer or seller, from a figure or position shown in the App, or from the App being unavailable.
Where liability cannot lawfully be excluded, our total liability to you for all claims taken together is limited to the amount you paid us for the App in the twelve months before the event giving rise to the claim, or one thousand Indian rupees (₹1,000), whichever is higher.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by our negligence, or for fraud.
21. Indemnity
You agree to indemnify and hold harmless Mirusoft Consultancy (OPC) Private limited, its directors, employees and developers against any claim, demand, loss, liability, cost or expense arising out of your use of the App; anything you, your staff or anybody using your account enters, posts or shares; any claim by a driver, staff user, party or other person about information you recorded or about how you used it; any GPS or other login you gave us; your dealings with any office, party, driver, buyer or seller; or your breach of these Terms or of any law.
22. Closing your account, and suspension
You can close your fleet account in the App, under Settings › Close this fleet account; only the owner can do it, and it needs a code sent to your number. Signing in stops at once on every device, your staff and linked computers included. Your fleet's records are erased after 30 days; signing in again before then calls it off. Your TrukZone Driver account on the same number is not touched. Closing the account does not cancel a Google Play or App Store subscription — cancel that in the store — and it does not take down a lorry you have put on the Market, so take that down first. We keep invoices and payment records for as long as the law requires.
We may suspend or close an account, or withdraw a feature from it, where we reasonably believe these Terms or the law have been broken, where a payment is reversed, or where it is necessary to protect other users or the service. Where it is practical and lawful, we will tell you why.
23. Changes to these Terms
We may change these Terms. When a change affects what you are agreeing to, the App will show you the new Terms and ask you to accept them before you continue; continuing to use the App after that means you accept the change. The current version is always readable in the App under Settings › About.
24. Apple and Google
These Terms are between you and us, not Apple or Google. We alone are responsible for the App and its content. Apple and Google have no obligation to provide maintenance or support for it. If the App fails to conform to a warranty that applies, you may tell Apple, and Apple may refund the price you paid for it; to the extent the law allows, Apple has no other warranty obligation for the App. We, not Apple, are responsible for addressing any claim about the App or your use of it — including product liability, failure to meet a legal or regulatory requirement, consumer protection or privacy law — and for any claim that the App infringes a third party's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not in a country under a government embargo or on a government list of prohibited or restricted parties.
25. Governing law and disputes
These Terms are governed by the laws of India. The courts at Thanjavur, Tamil Nadu have exclusive jurisdiction over any dispute between you and us arising out of these Terms or the App. This clause concerns disputes with us; a dispute with a driver, a staff user, an office, a party, a buyer or a seller is between you and them.
26. General
If any part of these Terms is found unenforceable, the rest continues to apply. Our not enforcing a term on one occasion does not mean we give it up. You may not transfer your account or your rights under these Terms without our agreement. These Terms, with the Privacy Policy, are the whole agreement between you and us about the App.
27. Language
These Terms are written in English, and the English text governs. Any translation is provided for convenience only.
